通汇电子旅行支票的条款和细则

通汇(香港)投资咨询有限公司(下称公司”)是非银行或存款企业类机构,并不会开展银行或存款业务。公司为万事达国际及银联卡组织会员,依照下列条款和细则发行通汇电子旅行支票(下称电子旅支”)。一经购买或使用通汇电子旅支,均须遵守下列条款和细则(下称“条款和细则”)。


1 定义

除非另有说明,下列词语应有以下含义:

[账户] 指公司创建及维护的电子旅支之每个特定内部记录,由被分配的电子旅支卡号进行识别及记录该电子旅支的交易;

[银行账户] 指(a)下列银行账户:

(上述银行下称银行”);

[银行利息] 指银行支付关于银行账户的银行利息;

[持卡人] 指名字已在网站进行注册的持卡人;

[信托声明] 指公司在2019年8月成立的信托账户之声明;

[有效期] 指电子旅支卡上印制的有效期;

[外币交易] 指任何使用非电子旅支帐户所属货币的币种进行之交易;

[香港] 指香港特别行政区;

[万事达卡] 指万事达卡国际组织;

[银联卡] 指银联卡组织;

[交易] 指使用电子旅支引起的商品交易,包括商品和/或服务的购买,或是在自动柜员机上的提款;

[交易金额] 指每笔交易产生的金额;

[通汇电子旅支] [电子旅支] 指公司签发具有特定账号及如卡上所示基础货币的增值金额之预付卡(外币必须根据相关兑换代理的汇率兑换成基础货币方能进行增值);

[通汇电子旅支网站][电子旅支网站] [网站] 指网站http://www.transforex.hk 或公司不时宣布的其他网站。


除非内文另有辨析,否则单数词包含其复数,反之亦然,而单一性别的词汇亦包含其各种性别。


2 电子旅支的基本特征

1. 电子旅支账户内的资金并非公司存款。电子旅支账户内的资金并非通过电子设备、磁带、光学法或其他方法存储在电子旅支实体卡中,而是存储在银行账户中。公司应依照信托声明,代相关持卡人持有银行账户内的资金(不包括银行利息)。

2. 针对电子旅支银行账户的资金余额,公司不会支付利息予持卡人。任何银行利息均属于公司,公司有权于任何时候从银行账户提取银行利息。

3. 持卡人同意支付给公司在本条款和细则中所述的任何费用、收费或开支,并特此授权公司从电子旅支资金中相应提取此类费用、收费或开支款项。

4. 持卡人同意依照公司和/或万事达卡和/或银联卡的记录,将其使用电子旅支进行消费的任何交易金额支付给相应的万事达卡或银联卡,并特此授权公司从该电子旅支的银行账户中提取相应之交易金额款项,于万事达卡和/或银联和/或公司不时自行规定的到期日前支付给卡组织。

5. 电子旅支报失。若电子旅支丢失或被盗,持卡人应立即向客户服务中心报失。报失时,客户服务人员将核实持卡人的身份和电子旅支的使用详情。在持卡人成功报失电子旅支后,电子旅支账户内的资金将被冻结。成功报失后,持卡人可以在通汇香港办公室或于购买电子旅支的指定销售点申请补发电子旅支卡。最新销售点位置可在电子旅支网站的销售点清单中查询。为确保持卡人的账户安全,客户服务人员将核实持卡人的身份。至于未能通过身份认证的持卡人,公司有权拒绝补发电子旅支,而电子旅支卡账户内的余额将不予退还,直到持卡人能提供有效身份证明文件。

6. 成功补发新电子旅支后,遗失的电子旅支账户内之余额将被转入新的电子旅支账户。公司对报失和补发新电子旅支将收取费用(详情请参考第5条),而持卡人应承担所有有关费用,并授权公司从其电子旅支账户中扣除该等费用。

7. 电子旅支的性质类似现金。未经持卡人授权的非法使用或盗用,公司无须将相关的交易金额退还予持卡人,并对因此类非法使用或盗用引起的任何损失或伤害概不负责。

8. 电子旅支是由持卡人用于消费。为了确保此用途,若电子旅支在一段时间内未被使用,公司将收取待用管理费(详情请参考第5条),而持卡人应承担该等费用并授权公司从其电子旅支的资金中扣除该等费用。

9. 公司终止电子旅支。公司有权自行在任何时候终止和取消电子旅支而无须提供任何理由,只须提前不少于7天通知持卡人,并将电子旅支账户内所有剩余资金(扣除任何交易金额,及相关条款和细则列明的费用、收费和开支后)退还予持卡人。在终止通知中,公司将要求持卡人于90天内提供其在香港的银行账户。若持卡人未能在90天内提供其银行账户数据,或公司无法在由终止通知当日起的90天内退还剩余资金予持卡人,则公司有权从其电子旅支账户中剩余的资金中扣除到期/终止账户管理费(详情请参阅第5条),直到剩余资金为零。至此,公司完全履行了其在相关条款和细则下以及信托声明中的所有责任。公司对关于电子旅支引起的任何损失或伤害概不负责。


3 如何使用电子旅支

1. 使用电子旅支前,持卡人须在通汇电子旅支网站上注册真实准确的个人资料,以便进行身份识别和日后获取电子旅支提供的相关服务,并完成电子旅支的网上启动。否则,公司不得提供关于电子旅支的任何服务,持卡人亦不能通过电子旅支进行付款,也不允许从电子旅支的账户内提款。对因持卡人未能注册或因错误或不准确的注册数据而造成的任何风险和损失,公司概不负责。

2. 万事达电子旅支卡只能在贴有万事达卡标识的终端和自动柜员机上使用;相对地,银联电子旅支卡只能在贴有银联卡标识的终端和自动柜员机上使用,或公司不时发布的其他终端和公司授权的交易中使用,只要电子旅支内有足够的资金进行交易和支付任何适用的费用即可。使用外币的交易会产生货币转换费(具体收费请参考第5条)。持卡人应承担所有该等费用,并授权公司从其电子旅支的资金中扣除该等费用。

3. 交易时,授权交易金额和相关费用会在持卡人的电子旅支账户资金内被实时冻结。一旦授权,交易不得终止或取消。持卡人特此授权公司向万事达卡/银联卡支付交易金额。

4. 在某些特定商户(包括但不限于特定酒店和餐厅)使用电子旅支时,此类商户可能会扣除额外金额作为小费,而持卡人特此同意并授权公司扣除此类收费。若对于此类收费有任何疑问,请直接与商户进行沟通。公司对因此类收费造成的任何损失或伤害概不负责。

5. 公司不建议持卡人使用电子旅支作预授权,例如保证付款─如酒店、邮轮或租车的保证金,因为此类商户会预估最终的账单,而该笔金额将暂时不可用。尽管最后只会从电子旅支中扣除该笔消费最终账单的实际金额,但从交易当日起到差额可用于消费之前可能需时多达30天。

6. 在电子旅支到期日前90天至到期日期后30天内,持卡人需提供个人身份证可在通汇香港办公室或于购买电子旅支的指定销售点更换新的电子旅支卡。最新销售点位置可在电子旅支网站的销售点清单中查询。若持卡人未能提供相关证件认证其身份,或未能在指定更换日期内进行更换,公司有权拒绝持卡人的更换申请,并终止该电子旅支卡及采用本条款与细则中第二条第九节「公司终止电子旅支」条文。成功更换后,原电子旅支账户内的余额将被转入新的电子旅支账户。若是在到期日90天前进行更换,持卡人应承担服务费。详情请参阅第5条。

7. 未用完资金的领回。若持卡人确定将不再使用电子旅支,持卡人可于最后一笔授权交易发生的30天后,凭有效身份证和电子旅支亲身到通汇香港办公室或于购买电子旅支的指定销售点领回余额,但公司有权扣除应付给万事达卡/银联卡的款项,以及持卡人因其名下所有电子旅支所产生对公司的欠款。适用的其他费用详情请参阅第5条。最新销售点位置可在电子旅支网站的销售点清单中查询。若持卡人未能提供相关文件和数据,公司有权拒绝持卡人领回余额的申请。

8. 电子旅支只限持卡人本人使用。持卡人应对电子旅支中的所有交易负责。电子旅支不得用于登录成人或赌博网站或在此等网站内购买商品,不得用于任何非法活动或用途。持卡人应遵守香港和购买/或使用电子旅支地区的所有相关法律法规(包括所有适用的外汇监管措施)。若公司有理由怀疑持卡人可能违反任何上述规定,或发现持卡人违反上述规定,公司有权暂停或取消其电子旅支,并/或终止本条款和细则。

9. 持卡人必须登录电子旅支网站并核实交易。若持卡人发现电子旅支下的交易未经批准或授权,持卡人应在交易完成后的60天内通知客户服务中心。若延期通知,持卡人应被视为批准该项交易,并同意承担该项交易产生的所有风险和责任。

10. 电子旅支不得转账。

11. 电子旅支不得透支。

12. 根据本条款和细则内有关持卡人应付的费用,若延迟付款,公司有权在无须提前通知持卡人的情况下从持卡人持有的任何电子旅支的余额中扣除款项。若持卡人认为扣除金额不正确,持卡人应立即向公司提出异议。


4 如何确保电子旅支和密码的安全

1. 持卡人在收到电子旅支后应尽快在卡背签名。一旦署名,卡将不可转让。注册数据应与签名一致,否则公司有权拒绝接受此类电子旅支交易。
2. 持卡人应采取一切合理可行的措施以确保电子旅支的安全性和密码的机密性,以及持卡人持有的电子旅支的其他保安信息。

3. 持卡人不得允许他人使用其电子旅支、密码或其他保安信息。

4. 若持卡人连续三次输入错误密码,该电子旅支账户可能会被冻结。一旦电子旅支被冻结,持卡人应联络客户服务中心重新启动。重新启动电子旅支需要24小时。

5. 若持卡人怀疑其电子旅支被盗用或被用于不恰当的用途,或其他人可能知道其电子旅支的密码或其他保安信息,持卡人应尽快登录电子旅支网站或联络客户服务中心冻结该电子旅支。若遗失的电子旅支随后被找到,持卡人可以登录电子旅支网站或致电客户服务中心重新启动该电子旅支。当客户服务人员与持卡人核实验证身份数据后,确认电子旅支能够继续使用,该电子旅支方能重新启动。

6. 公司可能需要持卡人书面确认遗失的、被盗的或不恰当使用的电子旅支的详细数据,或协助公司、任何执法机关和管理当局进行调查。

7. 持卡人应对电子旅支中所有未经授权的交易负责 ,包括但不限于以下情况:(a)持卡人从事欺诈或不诚实行为;(b)持卡人未能依照条款和细则使用电子旅支;(c)持卡人在其意识到电子旅支遗失、被盗或不恰当使用后未能报失;(d)持卡人未能采取合理措施确保电子旅支安全。

上述收费标准仅代表公司对上述操作的费用,并不包括某些自动柜员机营运商可能收取的额外费用,以及他们制定的限制或限额。公司将不时调整上述收费标准。请参阅电子旅支网站以获取最新收费标准。持卡人应承担上述费用并授权公司从其电子旅支的资金中扣除此类费用。

2. 担保交易限额
为了确保持卡人电子旅支账户资金的安全,公司设置了电子旅支交易金额和使用率限制。如对此安全限制有任何疑问,请致电客户服务中心。


6 商户和持卡人之间的关系

1. 在预期交易的商户拒绝接受电子旅支的情况下,公司对因此产生的任何损失概不负责。

2. 持卡人应直接与相关商户协商处理所有涉及交易的争议。在任何情况下,公司对涉及交易的任何争议均不承担责任。


7 个人资料收集

1. 公司可能通过持卡人提供的联络方式,以电话、邮寄或电邮联络持卡人。若姓名、地址、电话或电邮地址发生变更,持卡人应立即通知公司。
2. 通过购买和/或使用电子旅支,持卡人同意公司或公司的服务供货商或代理商依照公司的保密条例,处理本条款和细则下电子旅支服务的数据。

3. 为了提供电子旅支服务、产品宣传和促销活动、资料分析、反洗钱、犯罪调查、遵守法律法规、执法和防止欺诈等目的,公司可能向第三方提供持卡人的数据。

4. 持卡人的个人资料可能在购买地以外的其他国家或地区进行处理,但公司和所有服务供货商或代理商均会执行足够的安全措施以保障持卡人个人资料的安全。

5. 持卡人有权选择不收取公司的营销信息。若持卡人在申请期间没有选择拒绝接受营销信息的条款,即被视为不反对(即同意)公司使用或转让他们的个人资料作营销用途。 持卡人亦同意公司与其联系,以获得公司和其他联营机构提供的相关产品和服务。 如持卡人不希望收到此类信息,可随时联络本公司更改收取信息选项。持卡人亦同意公司将有关电子旅支的功能和与其电子旅支相关的信息发送至其手机,包括但不限于余额不足和即将到期等提示。

6. 根据保密和其他条例,持卡人可以联络公司并要求公司提供一份持卡人的个人资料副本。
7. 为协助公司提供电子旅支服务及提高公司服务质素,电话内容可能被录音和/或监听。持卡人同意接受此类录音和/或监听服务。


8 修订和通知

1. 公司可以自行修订条款和细则,一旦在电子旅支网站上公布或者通过公司认为适当的其他方式公布后随即生效。影响费用和收费及持卡人责任和义务的变更,将在公布30天后生效。此条款不适用于超出公司控制的变更。

2. 公司可能不时通过电子旅支网站发布所有有关于电子旅支的最新信息(包括根据本条款和细则内有责任发布的任何信息)。


9 免责条款
1. 除因公司严重疏忽或故意拖延导致的责任外,公司不应对电子旅支产生的任何损失或伤害负责。
2. 公司对任何自动柜员机或销售终端没有拥有权或经营权。公司对自动柜员机或销售终端拒绝使用电子旅支概不负责。


10 法律和司法管辖权

本条款和细则受香港法律管辖,并须按香港法律解释。持卡人同意服从香港法院的非专属性司法管辖权。


11 其他
1. 若本条款和细则内的全部或部分条款变成非法、无效或不能强制履行,其他条款均不受影响。
2. 根据本条款和细则,若公司未能采取行动或遗漏、延迟执行或履行任何权利,不得视公司为放弃相关权利。单一、部分或不当履行任何权利不会影响相关权利或任何其他权利的进一步履行。

3. 本条款和细则以中英文书写,两份具有同等效力。若中文文本和英文文本之间有任何不一致,当以英文文本为准。

2條 電子旅支的基本特徵

4. 持卡人同意依照公司和/或萬事達卡和/或銀聯卡的記錄,將其使用電子旅支進行消費的任何交易金額支付給相應的萬事達卡或銀聯卡,並特此授權公司從該電子旅支的銀行帳戶中提取相應之交易金額款項,於萬事達卡和/或銀聯和/或公司不時自行規定的到期日前支付給卡組織。

5. 電子旅支報失。若電子旅支丟失或被盜,持卡人應立即向客戶服務中心報失。報失時,客戶服務人員將核實持卡人的身份和電子旅支的使用詳情。在持卡人成功報失電子旅支後,電子旅支帳戶內的資金將被凍結。成功報失後,持卡人可以在通滙香港辦公室或於購買電子旅支的指定銷售點申請補發電子旅支卡。最新銷售點位置可在電子旅支網站的銷售點清單中查詢。為確保持卡人的帳戶安全,客戶服務人員將核實持卡人的身份。至於未能通過身份認證的持卡人,公司有權拒絕補發電子旅支,而電子旅支卡帳戶內的餘額將不予退還,直到持卡人能提供有效身份證明文件。

3條 如何使用電子旅支

2. 萬事達電子旅支卡只能在貼有萬事達卡標識的終端和自動櫃員機上使用;相對地,銀聯電子旅支卡只能在貼有銀聯卡標識的終端和自動櫃員機上使用,或公司不時發佈的其他終端和公司授權的交易中使用,只要電子旅支內有足夠的資金進行交易和支付任何適用的費用即可。使用外幣的交易會產生貨幣轉換費(具體收費請參考第5條)。持卡人應承擔所有該等費用,並授權公司從其電子旅支的資金中扣除該等費用。

3. 交易時,授權交易金額和相關費用會在持卡人的電子旅支帳戶資金內被即時凍結。一旦授權,交易不得終止或取消。持卡人特此授權公司向萬事達卡/銀聯卡支付交易金額。

5. 公司不建議持卡人使用電子旅支作預授權,例如保證付款─如酒店、郵輪或租車的保證金,因為此類商戶會預估最終的帳單,而該筆金額將暫時不可用。儘管最後只會從電子旅支中扣除該筆消費最終帳單的實際金額,但從交易當日起到差額可用於消費之前可能需時多達30天。

6. 在電子旅支到期日前90天至到期日期後30天內,持卡人需提供個人身份證可在通滙香港辦公室或於購買電子旅支的指定銷售點更換新的電子旅支卡。最新銷售點位置可在電子旅支網站的銷售點清單中查詢。若持卡人未能提供相關證件認證其身份,或未能在指定更換日期內進行更換,公司有權拒絕持卡人的更換申請,並終止該電子旅支卡及採用本條款與細則中第二條第九節「公司終止電子旅支」條文。成功更換後,原電子旅支帳戶內的餘額將被轉入新的電子旅支帳戶。若是在到期日90天前進行更換,持卡人應承擔服務費。詳情請參閱第5條。

7. 未用完資金的領回。若持卡人確定將不再使用電子旅支,持卡人可於最後一筆授權交易發生的30天後,憑有效身份證和電子旅支親身到通滙香港辦公室或於購買電子旅支的指定銷售點領回餘額,但公司有權扣除應付給萬事達卡/銀聯卡的款項,以及持卡人因其名下所有電子旅支所產生對公司的欠款。適用的其他費用詳情請參閱第5條。最新銷售點位置可在電子旅支網站的銷售點清單中查詢。若持卡人未能提供相關文件和資料,公司有權拒絕持卡人領回餘額的申請。

8. 電子旅支只限持卡人本人使用。持卡人應對電子旅支中的所有交易負責。電子旅支不得用於登錄成人或賭博網站或在此等網站內購買商品,不得用於任何非法活動或用途。持卡人應遵守香港和購買/或使用電子旅支地區的所有相關法律法規(包括所有適用的外滙監管措施)。若公司有理由懷疑持卡人可能違反任何上述規定,或發現持卡人違反上述規定,公司有權暫停或取消其電子旅支,並/或終止本條款和細則。

9. 持卡人必須登錄電子旅支網站並核實交易。若持卡人發現電子旅支下的交易未經批准或授權,持卡人應在交易完成後的60天內通知客戶服務中心。若延期通知,持卡人應被視為批准該項交易,並同意承擔該項交易產生的所有風險和責任。

10. 電子旅支不得轉帳。

11. 電子旅支不得透支。

12. 根據本條款和細則內有關持卡人應付的費用,若延遲付款,公司有權在無須提前通知持卡人的情況下從持卡人持有的任何電子旅支的餘額中扣除款項。若持卡人認為扣除金額不正確,持卡人應立即向公司提出異議。


4條 如何確保電子旅支和密碼的安全

1. 持卡人在收到電子旅支後應盡快在卡背簽名。一旦署名,卡將不可轉讓。註冊資料應與簽名一致,否則公司有權拒絕接受此類電子旅支交易。
2. 持卡人應採取一切合理可行的措施以確保電子旅支的安全性和密碼的機密性,以及持卡人持有的電子旅支的其他保安資訊。

3. 持卡人不得允許他人使用其電子旅支、密碼或其他保安資訊。

4. 若持卡人連續三次輸入錯誤密碼,該電子旅支帳戶可能會被凍結。一旦電子旅支被凍結,持卡人應聯絡客戶服務中心重新啟動。重新啟動電子旅支需要24小時。

5. 若持卡人懷疑其電子旅支被盜用或被用於不恰當的用途,或其他人可能知道其電子旅支的密碼或其他保安資訊,持卡人應儘快登錄電子旅支網站或聯絡客戶服務中心凍結該電子旅支。若遺失的電子旅支隨後被找到,持卡人可以登錄電子旅支網站或致電客戶服務中心重新啟動該電子旅支。當客戶服務人員與持卡人核實驗證身份資料後,確認電子旅支能夠繼續使用,該電子旅支方能重新啟動。

6. 公司可能需要持卡人書面確認遺失的、被盜的或不恰當使用的電子旅支的詳細資料,或協助公司、任何執法機關和管理當局進行調查。

7. 持卡人應對電子旅支中所有未經授權的交易負責 ,包括但不限於以下情況:(a)持卡人從事欺詐或不誠實行為;(b)持卡人未能依照條款和細則使用電子旅支;(c)持卡人在其意識到電子旅支遺失、被盜或不恰當使用後未能報失;(d)持卡人未能採取合理措施確保電子旅支安全。

2. 擔保交易限額
為了確保持卡人電子旅支帳戶資金的安全,公司設置了電子旅支交易金額和使用率限制。如對此安全限制有任何疑問,請致電客戶服務中心。


6條 商戶和持卡人之間的關係

1. 在預期交易的商戶拒絕接受電子旅支的情況下,公司對因此產生的任何損失概不負責。

2. 持卡人應直接與相關商戶協商處理所有涉及交易的爭議。在任何情況下,公司對涉及交易的任何爭議均不承擔責任。


7條 個人資料收集

1. 公司可能通過持卡人提供的聯絡方式,以電話、郵寄或電郵聯絡持卡人。若姓名、地址、電話或電郵地址發生變更,持卡人應立即通知公司。
2. 通過購買和/或使用電子旅支,持卡人同意公司或公司的服務供應商或代理商依照公司的保密條例,處理本條款和細則下電子旅支服務的資料。

3. 為了提供電子旅支服務、產品宣傳和促銷活動、資料分析、反洗錢、犯罪調查、遵守法律法規、執法和防止欺詐等目的,公司可能向第三方提供持卡人的資料。

4. 持卡人的個人資料可能在購買地以外的其他國家或地區進行處理,但公司和所有服務供應商或代理商均會執行足夠的安全措施以保障持卡人個人資料的安全。

5. 持卡人有權選擇不收取公司的營銷資訊。若持卡人在申請期間沒有選擇拒絕接受營銷資訊的條款,即被視為不反對(即同意)公司使用或轉讓他們的個人資料作營銷用途。 持卡人亦同意公司與其聯繫,以獲得公司和其他聯營機構提供的相關產品和服務。 如持卡人不希望收到此類資訊,可隨時聯絡本公司更改收取資訊選項。持卡人亦同意公司將有關電子旅支的功能和與其電子旅支相關的資訊發送至其手機,包括但不限於餘額不足和即將到期等提示。

6. 根據保密和其他條例,持卡人可以聯絡公司並要求公司提供一份持卡人的個人資料副本。
7. 為協助公司提供電子旅支服務及提高公司服務質素,電話內容可能被錄音和/或監聽。持卡人同意接受此類錄音和/或監聽服務。


8條 修訂和通知

1. 公司可以自行修訂條款和細則,一旦在電子旅支網站上公佈或者通過公司認為適當的其他方式公佈後隨即生效。影響費用和收費及持卡人責任和義務的變更,將在公佈30天後生效。此條款不適用於超出公司控制的變更。

2. 公司可能不時通過電子旅支網站發佈所有有關於電子旅支的最新資訊(包括根據本條款和細則內有責任發佈的任何資訊)。


9條 免責條款
1. 除因公司嚴重疏忽或故意拖延導致的責任外,公司不應對電子旅支產生的任何損失或傷害負責。
2. 公司對任何自動櫃員機或銷售終端沒有擁有權或經營權。公司對自動櫃員機或銷售終端拒絕使用電子旅支概不負責。


10條 法律和司法管轄權

本條款和細則受香港法律管轄,並須按香港法律解釋。持卡人同意服從香港法院的非專屬性司法管轄權。


11條 其他
1. 若本條款和細則內的全部或部分條款變成非法、無效或不能強制履行,其他條款均不受影響。
2. 根據本條款和細則,若公司未能採取行動或遺漏、延遲執行或履行任何權利,不得視公司為放棄相關權利。單一、部分或不當履行任何權利不會影響相關權利或任何其他權利的進一步履行。

3. 本條款和細則以中英文書寫,兩份具有同等效力。若中文文本和英文文本之間有任何不一致,當以英文文本為準。

Terms and Conditions of TransForex Electronic Travellers Cheque (e-Cheque)

TransForex (Hong Kong) Investment Consulting Co., Ltd. (the “Company”) is not and does not operate as a bank or deposit-taking institution. TransForex Electronic Traveller’s Cheque (“e-Cheque”) is issued by the Company pursuant to the licence provided by MasterCard Asia/Pacific Pte. Ltd and UnionPay International Co., Ltd., and in accordance with the following terms and conditions. By the purchase or usage of TransForex Electronic Traveller’s Cheque, you agree to comply with the following terms and conditions (“Terms and Conditions”).


Article 1: Definitions

Unless otherwise indicated, the following expressions shall have the following meanings herein:

[Account] refers to each specific internal record established and maintained by the Company in respect of the related e-Cheque, identified by the card number assigned to the e-Cheque and logging transactions of the e-Cheque;

[Bank Interest] refers to any interests paid by the Bank in respect of the Bank Account;

[Cardholder] means the person whose name has been registered as cardholder on the e-Cheque website;
[Declaration of Trust] means the Deed of Declaration of Trust executed by the Company in August 2019;

[Expiry Date] means the expiry date printed on the e-Cheque;

[Foreign Currency Transaction] means any transactions in currencies other than the base currency of the e-Cheque;

[Hong Kong] means the Hong Kong Special Administrative Region;

[MasterCard] means MasterCard International Incorporated;

[UnionPay] means UnionPay International Co., Ltd.;

[Transaction] means the commodity transaction, either the purchase of goods and/or services, or cash withdrawal from ATM, by the use of e-Cheque;

[Transaction Amount]
means the amount incurred in each Transaction;

[TransForex Electronic Travellers Cheque] or [e-Cheque] means the prepaid card issued by the Company with designated numbers for identification purpose and designated amount reloadable with the base currency stated on the card (foreign currencies may be loaded after being converted into the base currency at the foreign exchange rate determined by relevant exchange agents);

[TransForex e-Cheque website] or [e-Cheque website] or [Website] means the following website: http://www.transforex.hk or any other websites as the Company may announced from time to time.


Unless the context states otherwise, the singular includes the plural and vice versa, and one gender represents all genders.


Article 2: Basic Features of e-Cheque

1. Funds of e-Cheque Account do not count as deposit with the Company. Funds of e-Cheque Account are not stored in the physical e-Cheque card through electronic device, magnetic tape, optical method or any other methods, but in the Bank Account. The Company shall hold the funds (excluding Bank Interests) in the Bank Account on trust for Cardholders pursuant to the Declaration of Trust.

2. There is no interest payable to Cardholders on the balance of fund in e-Cheque Account. All Bank Interests belong to the Company and the Company is entitled to withdraw the Bank Interests from the Bank Account at any time.

3. Cardholders agree to pay to the Company any fees, charges or expenses as set out in these Terms and Conditions, and hereby authorize the Company to withdraw these amounts of fees, charges or expenses from the fund of the e-Cheque accordingly.

4. Cardholders agree to repay MasterCard or UnionPay any Transaction Amount incurred under their e-Cheque pursuant to the record of the Company and/or MasterCard and/or UnionPay, and hereby authorize the Company to withdraw the Transaction Amount from the fund of the e-Cheque and make payments to MasterCard or UnionPay respectively whenever it is due and payable, as determined by MasterCard and/or UnionPay and/or the Company on its or their discretion.

5. Report loss of e-Cheque. If e-Cheque were lost or stolen, Cardholders should immediately report loss to our Customer Service Centre. Our customer service officer shall verify the identity of the Cardholders and their e-Cheque usage information. Upon successful report loss of e-Cheque by the Cardholder, funds in the e-Cheque Account will be frozen. Cardholders may apply for re-issuance of their e-Cheque at TransForex Hong Kong office or its designated retailers where the e-Cheque was purchased. Please refer to the e-Cheque website for the latest information of designated retailers. To protect Cardholders’ interest, our customer service officer will verify the identity of Cardholders. The Company has the right to refuse re-issuance of e-Cheque to those who fail to be identified. In this case, any balance in the lost e-Cheque Account will not be refunded until valid proof of identity is submitted.

6. Upon successful re-issuance of new e-Cheque, balance in the lost e-Cheque Account will be transferred to the new e-Cheque Account. The Company shall charge fees for report loss and re-issuance of new e-Cheque (please refer to Article 5 for details), and Cardholders shall bear all these charges and authorize the Company to deduct these charges from the fund of the e-Cheque.

7. The nature of e-Cheque is similar to cash. In case of unauthorized usage or misuse by the Cardholder, the Company shall not refund the related Transaction Amount to the Cardholder nor be responsible for any loss or damage whatsoever or howsoever related to these Transactions.

8. e-Cheque is for the expenditures by Cardholders only. To ensure this purpose, management fees will be charged if the e-Cheque is not used for a certain period of time (please refer to Article 5 for details), and Cardholders shall bear these charges and authorize the Company to deduct these charges from the fund of the e-Cheque.

9. Termination of e-Cheque by the Company. The Company is entitled to terminate and cancel e-Cheque at any time at its sole discretion without providing any reasons, by providing not less than 7 calendar days’ advance notice to Cardholders and returning any remaining funds (after deducting any Transaction Amounts, fees, charges and expenses payable under these Terms and Conditions) in the e-Cheque Account to Cardholders. In the termination notice, the Company shall request Cardholders to provide their bank account information in Hong Kong within 90 calendar days. In the event that Cardholders fail to provide their bank account information within 90 calendar days, or the Company is not able or practicable to return the remaining fund to Cardholders within 90 calendar days from the date of the termination notice, the Company is entitled to deduct Expired / Terminated Account Management Fee (please refer to Article 5 for details) from any remaining funds in the e-Cheque Account until the remaining funds become zero. Until then, the Company shall fully discharge its duty under these Terms and Conditions as well as the Declaration of Trust, and the Company shall not be liable for any loss or damage whatsoever or howsoever related to or in respect of e-Cheque.


Article 3: How to use your e-Cheque

1. Before using e-Cheque, one shall first register their true and accurate personal information on the TransForex e-Cheque website, for the purpose of identification and subsequent provision of e-Cheque related services. The online activation of the e-Cheque is then complete. Failure in the registration and activation of e-Cheque will lead to service abruption, where no payments can be made by the e-Cheque and no withdrawal of cash shall be allowed from the e-Cheque.  The Company will not be responsible for any risk and loss caused by Cardholders' failure in registration or false or inaccurate registered information.

2. MasterCard e-Cheque can only be used at terminals and ATMs with the MasterCard® logo while UnionPay e-Cheque can only be used at terminals and ATMs with the UnionPay® logo while or other terminals published by the Company from time to time. Transactions will only be authorized by the Company when there are sufficient funds in the e-Cheque Account for the Transaction, including any applicable fees. Transactions in foreign currencies will incur currency conversion fee (please refer to Article 5 for specific rates). Cardholders shall bear all these fees and authorize the Company to deduct these fees from the fund of the e-Cheque.

3. At the time of Transaction, authorized Transaction Amount and the related fees will immediately be held up from the fund in the e-Cheque Account. Once the Transaction is authorized, the Transaction cannot be terminated or cancelled, and Cardholders hereby authorize the Company to pay the Transaction Amount to MasterCard or to UnionPay as the case concerned warrant.

4. Some merchants (including but not limited to hotels and restaurants) may deduct extra amount from e-Cheque as tips. Cardholders hereby agree and authorize these deductions. If in doubt, please communicate directly with the merchants. The Company shall not be liable for any loss or damage whatsoever or howsoever related to these deductions.

5. Cardholders are not recommended to use e-Cheque for pre-authorization, such as payment guarantee for deposits at hotels, cruise lines or car rental. These merchants may estimate the final bill and the amount will be temporarily held up from the e-Cheque. Although only the actual amount of the final bill will be deducted from the e-Cheque, it may take up to 30 days from Transaction date before the amount is released for spending.

6. Within 90 days before the Expiry Date and 30 days after the Expiry Date of e-Cheque, Cardholders may replace their e-Cheque with new e-Cheque at TransForex Hong Kong office or its designated retailers where the e-Cheque was purchased, by providing proof of identity of the original e-Cheque. Please refer to the e-Cheque website for the latest information of designated retailers. If Cardholders fail to authenticate their identity by providing related documents, or conducting replacement within the abovementioned days, the Company has the right to deny the application for replacement. In this case, the Company has full discretion to terminate the e-Cheque and apply the “Termination of e-Cheque by the Company” clause stated in Article 2 Clause 9. Upon successful replacement, balance in the original e-Cheque Account will be transferred into the new e-Cheque Account. In case of e-Cheque replacement before 90 days of the Expiry Date, Cardholders shall bear the service charge for early replacement. Please refer to Article 5 for details.

7. Redemption of Unspent Funds. If Cardholders surrender their e-Cheque, they may, after 30 days from the last authorized Transaction date, redeem the balance in the e-Cheque at TransForex Hong Kong office or its designated retailers where the e-Cheque was purchased, with their proof of identity and e-Cheque. Please refer to the e-Cheque website for the latest information of designated retailers. However, the Company has the right to deduct any amount payable to MasterCard or UnionPay as the transaction warrants and any amount owed to the Company from all e-Cheque under the Cardholder’s name. Other fees will also apply, please refer to Article 5 for details. If Cardholders fail to provide related documents and information, the Company has the right to deny the application for redemption of balance.

8. e-Cheque is for its Cardholder’s own use. Cardholders are responsible for all Transactions under the e-Cheque. e-Cheque may not be used for accessing or purchasing from any pornography or gambling websites, and must not be used for illegal activities or purposes. Cardholders shall abide to all laws and regulations related to e-Cheque in Hong Kong and in the countries where the e-Cheque is purchased or used (including all applicable foreign exchange regulations). If the Company suspects that Cardholders may be / are found to be in breach of any foregoing provisions, the Company has the right to suspend or terminate their e-Cheque and/or cease these Terms and Conditions.

9. Cardholders are obligated to log into the e-Cheque website and verify all Transactions. If any unauthorized Transactions were found, Cardholders should inform our Customer Service Center within 60 days of the Transaction date. Failure to do so will be deemed as Cardholders’ approval in these Transactions, and Cardholders agree to bear all risks and liabilities of these Transactions.

10. No transfer of money is allowed in e-Cheque.

11. No overdraw is allowed in e-Cheque.

12. As for the amount payable by Cardholders in accordance with these Terms and Conditions, the Company has the right to make deductions from the balance of any e-Cheque held by Cardholders without advance notice for late payment. If Cardholders discover any incorrect deductions, they should dispute these deductions with the Company immediately.


Article 4: How to ensure safety of e-Cheque and PIN

1. Cardholders should sign their name on the back of the card upon receipt of their e-Cheque. Once it is signed, it is non-transferable. Registered information should be identical to the signature, or the Company has the right to deny the e-Cheque.
2. Cardholders should take all reasonable and feasible measures to ensure security of the e-Cheque card, confidentiality of the PIN and other information of the e-Cheque.

3. Cardholders should not allow others to use their e-Cheque, PIN or other security information.

4. If the PIN was input incorrectly for consecutively three times in the same Transaction, the e-Cheque Account may be frozen. If the e-Cheque was frozen, Cardholders should contact our Customer Service Center to reactivate it. It will take 24 hours for reactivation.

5. If Cardholders suspect misuse of their e-Cheque, or anyone else may have knowledge of their PIN or other security information, they should log into the Cardholder website or contact our Customer Service Center and suspend the e-Cheque as soon as possible. If lost e-Cheque were found later, Cardholders should log into the e-Cheque website or call our Customer Service Center to reactivate the e-Cheque. The e-Cheque will not be reactivated before our customer service officer has successfully verified the identity of Cardholders and before the e-Cheque is confirmed to be fit for continuous use.

6. The Company may require Cardholders to provide detailed information of lost, stolen or inappropriately used e-Cheque in writing, and assist the Company and any law enforcement and administration authorities with investigation.

7. Cardholders are responsible for all unauthorized Transactions under their e-Cheque, including but not limited to following situations: (a) Cardholders are engaged in fraudulent or dishonest events; (b) Cardholders fail to use e-Cheque in accordance with these Terms and Conditions; (c) Cardholders fail to report loss after they are aware of the loss, theft or inappropriate use of their e-Cheque; (d) Cardholders fail to take reasonable measures to ensure security of their e-Cheque.

The standard fees above merely represent the Company's charges for the items above, which do not include extra fees possibly charged by some ATM operators and merchants or the restrictions or limits established by them. The Company will adjust these standard fees from time to time. Please refer to the e-Cheque website for the latest information. Cardholders should bear the above fees and authorize the Company to deduct these fees from the fund of the e-Cheque.

2. Secured Transaction Limits
To protect the e-Cheque Account, the Company has applied restrictions over Transaction Amount and the frequency of e-Cheque Transactions. For more information about security restrictions, please call our Customer Service Center.


Article 6: Relationship between Merchants and Cardholders

1. In the event that a merchant refuses to accept e-Cheque, the Company is not liable for any loss or damage whatsoever or howsoever related to the refusal.

2. Cardholders shall handle all disputes in relation to Transactions directly with relevant merchants. Under no circumstances shall the Company be responsible or liable to any disputes in relation to Transactions.


Article 7: Collection of Personal Information

1. The Company may contact Cardholders through telephone, mailing address or email address registered by Cardholders. In case of changes in name, mailing address, telephone number and/or email address, Cardholders should inform the Company immediately.
2. Through the purchase and/or usage of e-Cheque, Cardholders agree that the Company or the Company's service providers or agents may deal with information collected through e-Cheque services under these Terms and Conditions, in accordance with the privacy policy of the Company.

3. The Company may provide information of Cardholders to third parties for the purpose of e-Cheque service provision, product marketing and promotional activities, information analysis, anti-money laundering, crime investigation, adherence to laws and regulations, law enforcement and fraud prevention.

4. Personal information of Cardholders may be processed in other countries or regions outside the place of purchase, but the Company and all service providers or agents shall apply sufficient security measures to safeguard the personal information of Cardholders.

5. Cardholders have the right to opt out of direct marketing. If Cardholders do not opt out during application to signify their acceptance of the terms and conditions, they will normally be regarded as having indicated they have no objection (i.e. consent) to the use or transfer to third parties of their personal data for use in direct marketing. Cardholders agree that the Company may contact Cardholders for other related products and services provided by TransForex and other affiliated parties. If Cardholders do not wish to receive these information, they may contact the Company to express their consent at any time. Cardholders also agree that the Company may send information related to e-Cheque functions or status to their mobile phone, including but not limited to alerts about insufficient balance and Expiry Date.

6. Cardholders may contact the Company for a copy of their personal information held by the Company in accordance with the privacy and other related policies.
7. To assist the Company in providing e-Cheque services and improving service quality, telephone communications may be recorded and/or monitored. Cardholders hereby agree to these recording and/or monitoring.


Article 8: Amendments and Notifications

1. The Company may, at its discretion, change any of these Terms and Conditions with immediate effect by publishing the changes on the e-Cheque website or through other ways deemed appropriate by the Company. Changes affecting fees and charges and the liabilities or obligations of Cardholders will take effect 30 days after they are published. This clause does not apply to changes beyond the Company’s control.

2. The Company may, from time to time, publish up-to-date information related to e-Cheque (including information obliged to publish under these Terms and Conditions) via the e-Cheque website.


Article 9: Indemnification Clause
1. The Company shall not be liable for any loss or damage whatsoever or howsoever related to e-Cheque, except when it is caused by gross negligence or willful default of the Company.
2. The Company does not have ownership of any ATMs or sales terminals, or operate any ATMs or sales terminals. The Company will not be liable for rejection of e-Cheque by ATMs and sales terminals.


Article 10: Laws and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of Hong Kong. Cardholders irrevocably submit to non-exclusive jurisdiction of the court in Hong Kong.


Article 11: Miscellaneous
1. Should whole or part of any terms under these Terms and Conditions become illegal, invalid or unenforceable, other terms shall still be in force.
2. Should the Company fails to take action or omits or delays performance or implementation of any rights under these Terms and Conditions, the Company shall not be deemed to have surrendered those rights. Single, partial or defective performance of any rights shall not prejudice further performance of those rights or any other rights.

3. These Terms and Conditions are written in both Chinese and English. Both are equally valid. Should there be any inconsistencies, the English version shall prevail.
